Nightkettle: terms of use (TEMPLATE)
TEMPLATE. Have it reviewed by a qualified professional before publishing. Replace every
[BRACKETED]placeholder. App stores add their own terms (e.g. Apple's standard EULA, and Google Play's terms of service), and the store's terms apply too for store purchases.
Effective date: [DATE] These terms are an agreement between you and [YOUR NAME OR BUSINESS NAME] ("we", "us") for your use of Nightkettle ("the app").
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for [personal / your own business] purposes, in line with these terms and the terms of the store or website you got it from. You may not resell, sublicense or redistribute the app, or remove our notices, unless you have bought a separate source-code, white-label or commercial licence.
2. Your data stays on your device
The app stores what you enter only on your device (see the Privacy Policy). You are responsible for your data. We cannot access, back up or recover it. Clearing your browser or app data, uninstalling, changing device or browser, or device failure can permanently delete it. Use the Export feature to keep copies.
3. Important limitations
- Wellness only, not medical. Nightkettle is a relaxation and journaling tool. It is not a medical device and does not diagnose, treat, cure or prevent any condition, including sleep disorders. The sleep score and insights summarise your own entries and are not medical measures.
- Breathing exercises: breathe gently and stop if you feel dizzy, light-headed or unwell. Don't use breathing exercises or audio while driving or operating machinery.
- Volume: keep sound at a comfortable level.
- If you have ongoing sleep problems, consult a healthcare professional.
4. Acceptable use
Don't use the app to break the law, infringe others' rights, or harass or mislead anyone (for example in messages or documents you create with it).
5. Purchases and refunds
- Store purchases: refunds follow the store's refund policy.
- Direct purchases: [REFUND POLICY, e.g. "14-day no-questions refund"]. Statutory consumer rights in your country are not affected.
6. Updates and availability
We may update, change or stop offering the app. Updates are delivered through the app's service worker or the store. We don't guarantee the app will be available, error-free or compatible with every device or browser.
7. Disclaimer of warranties
To the extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
8. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of the app. Our total liability is limited to the amount you paid for the app in the 12 months before the claim (or [AMOUNT] if you paid nothing). Nothing here limits liability that cannot be limited by law (e.g. for death or personal injury caused by negligence, or for fraud).
9. Governing law
These terms are governed by the laws of [JURISDICTION], and disputes go to the courts of [JURISDICTION], unless your local consumer law gives you the right to bring proceedings where you live.
